KVT Limited

1. Introduction

These Terms and Conditions ("Agreement") govern the services provided by KVT Limited ("Trainer", "we", "our"), owned and operated by Kaitlyn Vaughan. By booking, attending a training session, or subscribing to communications from KVT Limited, you agree to these terms.

2. Services Provided

KVT Limited provides personal fitness training services, including but not limited to:

One-on-one training sessions
Small group training
Fitness assessments
Personalised programming
Ongoing support and accountability

Services may be delivered in person or through digital communication, depending on the nature of your package.

3. Privacy and Data Sharing

We collect personal information including medical history, fitness data, and contact details to deliver safe and effective training services.
This data is used to:

Design appropriate fitness programs
Monitor your progress
Communicate with you about sessions, updates, and offers
Provide support between sessions

Your information is securely stored and not shared with third parties without your consent, except as required by law or as outlined below.

Facility Disclosure: KVT Limited operates out of Lift HQ Timaru. Your relevant personal and training data (such as name, date of birth, phone number, email & emergency contact, booking and attendance details) will be shared with Lift HQ Timaru for operational purposes only. Lift HQ Timaru is not responsible for the design or supervision of your training program.

You may access, update, or request deletion of your personal data at any time by contacting kaitlyn@kvt.co.nz.

4. Marketing Consent

By subscribing or providing your contact details, you consent to receiving updates, offers, and information from KVT Limited. You may opt out at any time via the unsubscribe link or by contacting us directly.

5. Booking and Payment

All sessions must be pre-booked.
Payment must be made in advance or by the time of the session.
Accepted payment methods: Bank transfer, Stripe, or cash (where agreed).

6. Cancellations and No-Shows

We understand life happens – here’s what to expect:

Cancellations must be made at least 24 hours before the scheduled session.
Cancellations within 24 hours may be charged 50% of the session fee.
No-shows will be charged 100% of the session fee.
You may cancel any ongoing package or service at any time. No further charges will apply after cancellation; however, past payments are non-refundable.

7. Health and Medical Acknowledgement

By participating, you confirm that:

You are in suitable physical condition for training and have obtained medical clearance if necessary.
You have disclosed all relevant medical or health information and will update KVT Limited with any changes affecting your ability to safely participate.

Training involves physical exertion and carries inherent risk. Participation is entirely voluntary and undertaken at your own risk.

8. Liability Waiver

By engaging with KVT Limited, you acknowledge and agree that:

KVT Limited and its contractors are not liable for any injury, illness, loss, or damage sustained as a result of participation, unless caused by gross negligence.
Lift HQ Timaru provides the premises only and holds no responsibility for your training, results, or supervision.
You release and discharge KVT Limited, Lift HQ Timaru, and their associated persons from any legal claims related to your participation.

9. Termination of Agreement

You may terminate services at any time. Any pre-paid sessions not used may be credited or forfeited, depending on the terms of your agreement. KVT Limited may also terminate services with reasonable notice if required due to conduct, safety, or other circumstances.

10. Changes to Terms

KVT Limited reserves the right to update these terms. Clients will be notified of changes, and continued use of services will constitute acceptance of the new terms.

11. Governing Law

This Agreement is governed by the laws of New Zealand. Any disputes will be subject to the jurisdiction of the courts in Timaru, New Zealand.
